Homebuyers, investors want RM16mil damages per year

Kota Kinabalu: Fed up homebuyers and investors of a high-rise project in Sulaman are demanding the developer pay RM16 million per year in liquidated damages after being made to wait for their houses for more than two years."It is unfair for investors who are losing money because of this delay. But the worst hit would be first-time homebuyers who are forced to rent other houses while waiting for their units to be completed and service the bank mortgage at the same time.

"We demand that the developer come clean on the real reasons for the delay and more importantly, when can we expect our houses to complete?" said a representative of the buyers' action committee who wished to be identified as Tom.

Tom also questioned the legality of the developer claiming that the project is now 80 per cent completed in 2011 when physically, the project does not seem to exceed that, four years on.

On Thursday about 40 disgruntled buyers and investors attended a one-hour meeting with Likas Assemblyman Junz Wong and Inanam Assemblyman Roland Chia who promised to continue to pursue the matter in the State Legislative Assembly sitting next month.

They unanimously agreed to give the developer two weeks to respond to their demand and threatened to take their case to court in the event the developer continues to ignore their pleas.

Junz who is also Sabah Democratic Action Party (DAP) Organising Secretary said his team will provide the buyers' action committee with legal assistance to pursue the matter legally.

"The action committee will meet up with our legal team next week to discuss further on the next action which includes suing the developer for breach of contract, pursuing the liquidated damages as well as to look into the over-claim issue," he said.

He urged more buyers to come forward and join the action committee to seek a solution to the problem.
