Umno woman sues Najib for US$650m

Kuala Lumpur: An Umno Wanita member Friday filed a suit against party president Datuk Seri Najib Abdul Razak and party executive secretary Datuk Ab Rauf Yusoh to reclaim a portion of the RM2.6 billion party donation.The suit was filed by Langkawi Umno member Anina Saaduddin at the High Court.

In her suit, among others, she said that pursuant to Section 14(d) of the Societies Act, Umno was required to provide its audited accounts for every financial year to the ROS and under Section 26 of the same act, submit its accounts to be audited by an auditor and approved by the ROS.

Anina, who recently created a stir when she came out strongly against the party president and accused him of "cheating" Umno is seeking an injunction against Najib and Abdul Rauf or their agents in the disciplinary board, state liaison body, divisions, and branches to be restrained from removing, suspending and taking disciplinary action on her, pending the disposal of this action.

She is also seeking:

• repayment of US$650 million, said to be the balance from the original US$ 681 million (RM2.6billion) deposited into his account.

• an account of all money he (Najib) received in the form of donations.

She stated that Najib has breached the Umno constitution, the Provision Societies Act, and common law as a trustee of the donations.

She also argued that the sum of RM2.6 billion allegedly did not appear in the party's audited accounts for the financial year 2013 and 2014.

The claimant said that Najib admitted to receiving the amount and that he was not personal beneficiary to the funds as he was only a trustee of the funds.

The claim further stated that Najib did not declare the RM2.6billion to Umno, instead making its way into his private accounts through AmBank and a Singaporean bank.

It also said that the supreme council is unwilling or unable to act against the Umno president because of s power in the party.

Anina said she was filing the suit alone on behalf of the Umno party members.

"I am doing this because I love Umno, and I believe all party members love Umno. I feel this is my responsibility in the interest of the three million Umno members," she said to reporters at the Jalan Duta High court lobby today.

She said that Najib, in his capacity as Umno president, had committed a breach of trust and the party constitution by accepting the RM2.6billion.

"I appeal to Najib as president of the party to be honest and fair to party members," she said.

Anina also said that she was not afraid of the prospect of expulsion from the party.
