Three jailed for life over Dutch boy abduction

Kuala Lumpur: The three men involved in the high-profile kidnapping of a Dutch boy were sentenced to life in prison and six strokes of the rotan by the High Court here.Self-employed Chong Tat Siong, 27, together with handphone seller Foong Khar Fai, 23, and unemployed Lee Phak Seng, 26, were convicted of kidnapping the then 12-year-old boy, with the intent of obtaining a RM300,000 ransom. Justice Kamardin Hashim ruled that the defence had failed to raise reasonable doubt against the prosecution's case. Section 3 of the Kidnapping Act 1961 is punishable by either the death penalty or life in prison.

Justice Kamardin took into account the victim's Dutch nationality, saying that as a civil country, Holland did not practise the death penalty. "That said, this is a serious offence, in Malaysia it carries a death or life sentence," he said.

Lawyers for the defence were Rajinder Singh, Datuk Hanif Hashim, K. T. Wong, and Choong Joo Tian, while DPP Nordin Ismail acted for the prosecution. Chong, Foong and Lee had claimed trial to kidnapping the boy at Jalan Kiara 1, Mont Kiara, here, on April 27, 2012.

On Jan 16, the High Court ordered the three to enter their defence, accepting the testimony of the victim and his father.

The boy's testimony had identified Chong, Foong and Lee as the people who had kidnapped him from outside his school, held him in a house in Chemor, Perak and later released him at a rest stop in Rawang. The father testified that he had received the ransom threat through his son's Facebook account and had agreed to the RM300,000 fee.
