Rapes: Tapper gets 65 years, 18 strokes

Kota Kinabalu: A 30-year-old Dusun rubber tapper will have to spend 65 years behind bars and get caned 18 times for raping two underage girls and trying to rape another two.Petrus Jung of Kota Marudu, who was brought before Sessions Court Judge Ainul Shahrin Mohamad on Monday pleaded guilty to committing the offences at separate locations between July 7, 2014 and June 15 this year.

Petrus, who has a previous conviction for attempted rape, had lured the minors aged between 10 and 12 years to get on his motorcycle before he took them to an isolated place and committed the crime.

He was sentenced to 10 years' jail and ordered given three lashes of the cane on the first count of trying to rape a 10-year-old girl and causing hurt to her at the time of the offence at 1pm on Dec 5, 2014 in the bushes along Jalan Inobong- Terian in Penampang.

On the second count, Petrus was jailed 20 years and ordered caned six times for raping an 11-year-old girl and at the same time causing hurt to the victim at 1.40pm on June 19 this year in the bushes at a village in Kota Marudu.

Petrus was handed 20 years' jail plus six strokes of the cane on the third count of raping another 11-year-old girl and at the same time placing her under fear of death at 1.30pm on July 7, 2014 in the woods of a village in Kota Marudu.

On the fourth count, Petrus received another 15 years' jail and three lashes of the cane for trying to rape a 12-year-old girl and at the same time causing hurt to her at 10.30am on June 27 this year in the bushes at a village in Kota Belud.

Ainul ordered Petrus to serve the jail term on the first count from Monday and the remaining sentences to be served consecutively.

Petrus requested for leniency saying he has three children aged between three and 14 and also applied for his sentences to run concurrently from the date of his arrest on Aug 17 this year.

Legal aid counsel Hamid Ismail, who represented Petrus for mitigation, told the court that Petrus, who studied until Form 1, regretted the offence he had committed.

However, Deputy Public Prosecutor (DPP) Akmalzatul Mohamed Nawi urged the court to impose a deterrent sentence on Petrus due to the seriousness of the offence which involved underage girls and that the incident had left the victims traumatised.

Pressing for the sentences to run consecutively, the DPP told the court that Petrus had one conviction record where he was jailed one year by the Sessions Court in Johor Bahru on May 9, 2013 for attempted rape.

Earlier, Akmalzatul in presenting the facts of the cases, informed the court that on the first count, Petrus had approached the victim who together with her younger sibling, were waiting for their father at Donggongon town.

Petrus, who was not known to the victim, pretended to call their father on a handphone before telling her that he would send them on his machine.

Petrus however, send the victim's young sibling to their rented room at the same town and thereafter brought the victim to the bushes on a hill along Jalan Inobong – Terian where he tried to rape her.

The victim put up a fight prompting Petrus to hit her but she managed to escape and fell into a thicket. Petrus, who could not see where she was left her, and the girl then came out to seek help from the public.

On the second count, Akmalzatul said Petrus approached the 11-year-old girl who was with her six year-old brother and invited them to ride pillion on the pretext of asking for direction to a place selling birds.

Petrus however left the girl's brother by the roadside and proceeded further into the bushes, dragged the girl there and raped her.

The girl tried to fight him off but was struck by him, leaving her in a weakened state.

Petrus then left the girl, who walked out to the road and met her young brother before they walked toward a restaurant and asked for help.

On the third count, the court heard that Petrus invited the victim and her cousin to take a ride on his motorcycle and brought them into the woods.

Petrus then pulled the victim further into the woods and raped her, threatening to kill her if she did not given in to him.

Meanwhile, on the fourth count, Petrus had approached the victim, who was walking home with her two young brothers and offered to send her back telling her that he was a friend of their parents.

The victim agreed with the offer only to be brought into the bushes.

Petrus tried to rape her but she put up a fight prompting Petrus to punch her face and abdomen.

However, the girl managed to escape and hid in a bushes for five minutes until Petrus left.

She then came out from her hiding place and ran towards the village for help.
