Top cop claims trial to abusing position

Kota Kinabalu: A senior police officer claimed trial in the Special Corruption Court on Monday to abusing his position by approving a food catering tender of RM432,000 to a company belonging to his nephew.Assistant Commissioner of Police Abd Radzak Abd Ghani, 54, appeared before Sessions Court Judge Indra Ayub to face the charge against him.

He came to court using a walking stick and accompanied by his siblings and other relatives.

Abd Radzak is accused of using his position as a member of the Evaluation and Quotation Selection Committee here in choosing Syarikat Fulscale Development owned by his nephew one Sharial Taufan Nerawi.

The charge stated that Abd Radzak who is attached with the State police headquarters had awarded the cooked food ration supply tender for detainees in police lock-up from May 1, 2014 until Apr 30, 2016.

He allegedly committed the offence at 11.30am on Apr 1, 2014 at the meeting room of the State Police Commissioner office in the Kepayan Police headquarters, near here.

The offence under Section 23 of the Malaysian Anti-Corruption Commission (MCC) Act 2009 punishable under Section 24 of the same Act provides for a jail term of up to 20 years, and a fine of not less than five times the amount involved or RM10,000, whichever is higher.

Indra fixed Nov 12 this year for case management and Dec 10 to hear the case.

Abd Radzak was released on a bail of RM20,000 with RM5,000 deposited in a local surety.

Earlier, Prosecuting Officer Awang Shamsul Baharam Bongsu who was assisted by Michael Joimin from MACC proposed bail at RM10,000 with RM8,000 deposited.

However, counsel Zahir Shah who defended Abd Radzak asked for a bail sum of RM5,000 on the grounds that his client, who is a local, is still working with the police.

In the same court, another policeman was charged with receiving a bribe of RM500 from a woman.

Lance Corporal Awang Mohamad Awang Sahari, 40, from Sarawak, pleaded not guilty to accepting the bribe from one Meriam Husin between 1pm and 2.30pm on March 11, 2010 inside a car in Lorong Ceri, here.

He allegedly received the money as a reward to not take action against Meriam and another man, Jhon Cleent Leonie who did not have any valid documents at the time.

Awang Mohamad who was not represented applied for a bail sum of RM5,000 as he has two children to look after and also needs to repay his personal loan.

He also informed the court that his father had just passed away last Wednesday in Sarawak.

The court offered Awang Mohamad bail at RM20,000 with RM5,000 deposited in a local surety.

His case will be heard on Dec 11.
