Forging endorsement on passport: Man jailed 5 years, fined RM50,000

Kota Kinabalu: A 34-year-old local was sentenced to five years' jail and fined RM50,000 in default a year's jail for falsifying an endorsement on a passport.High Court Deputy Registrar Mohd Hafizi Abdul Halim, who sat as a Sessions Court judge, also handed two strokes of the cane to Mohd Redzuan Alim after he changed his plea during his trial after the prosecution had called two witnesses.

Mohd Redzuan admitted to forging the endorsement on the document at 5.40pm on Aug 11, 2014 at a house in Kg Tagas, Tuaran.

He committed the offence under Section 55D of the Immigration Act 1959/63, which carries a fine of between RM30,000 and RM100,000, and a jail term of between five years and 10 years and whipping of up to six strokes, on conviction.

During mitigation, Mohd Redzuan asked for a lenient sentence saying that he has two children who are currently under the custody of his former wife, to look after.

However, Deputy Public Prosecutor Akmal Baharuddin who was assisted by Prosecuting Officer Hamisah Hj Puteh from the Immigration Department urged the court to impose a heavy sentence on the grounds that the case involved the interest of the public.

Meanwhile, in another court, the four Sabah Sarawak Keluar Malaysia (SSKM) activists charged with having materials urging Sabah and Sarawak to leave Malaysia will go trial on Jan 25-27 next year.

The court fixed the date for Azrie Situ, 24, Jemmy Liku Markus Situ, 32, Erick Jack William, 29, and Joseph Koilis, 29 when their case was brought up for mention on Tuesday.

The four had, on March 16 this year, pleaded not guilty to having the pamphlets with the seditious content at 9.50am on Feb 1 this year at the weekly Tamu in Tuaran.

Erick allegedly had 91 pieces of the seditious pamphlets, Joseph had 13 pieces, Azrie five pieces and Jemmy had one piece.

The offence under Section 4(2) of the Sedition Act carries a fine of up to RM2,000 or a jail term of up to 18 months, or both, on conviction and the offending publication is to be seized and destroyed.

The four were released on bail of RM20,000 with RM10,000 deposited in a local surety each as well ordered to surrender their passports, if any, to the court.
