Filipino's drug trafficking charge reduced to possession

Kota Kinabalu: A 34-year-old Filipino, charged with trafficking 63.06gm of syabu, was offered a lesser charge of drug possession.The prosecution offered the alternative charge to Hamid Ali, whose case was brought for mention before High Court Deputy Registrar Mohd Zairi Zainal Abidin on Tuesday.

However, Zairi set Feb 18 for hearing of the case before a High Court judge.

Hamid's plea on the alternative charge would only be recorded on that date. The registrar also directed parties to prepare their facts and submissions for the date should Hamid plead guilty to the alternative charge. Hamid was originally charged with trafficking the drugs at 5pm on Aug 14, 2014 in front of a budget hotel in Ranau town.

The main charge under Section 39B(1)(a) of the Dangerous Drugs Act carries the death sentence on conviction, while the alternative charge under Section 39A(2) of the same Act provides for a punishment of imprisonment for life or not less than five years and liability of a minimum of 10 strokes of the cane.

Hamid is currently serving five years' jail and ordered caned twice for taking drugs for the third time, an offence under Section 39C of the Dangerous Drugs Act, which carries a jail term of between five years and seven years and whipping of not more than three strokes.
