Drug trafficking: China woman enters defence

Kota Kinabalu: The High Court hearing a drug trafficking case involving a woman from China fixed March 3 for submissions from both parties.Judge Datuk Nurchaya Arshad set the date when Cheng Jin Hui, 24, closed her defence after she testified under oath as a sole witness on Tuesday.

The court directed Cheng's counsel and the prosecution to make an oral submission on that day.

Cheng is accused of trafficking 1,397.1gm of syabu at 11.25pm on July 6, 2014 at the passengers' examination area at the arrival hall in Terminal Two of the Kota Kinabalu International Airport (KKIA).

She was on Dec 3, 2015 ordered to enter her defence to the charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which carries the death penalty on conviction.

In her defence, Cheng testified that a friend by the name of one Gomez, whom she had known for about a year, had asked her to send samples of women's clothing to his friend here.

She said while at Guangzhou, China, Gomez's friend, who was unknown to her, gave her a pink-coloured luggage before she travelled by bus to Hong Kong for her flight to Kota Kinabalu.

Cheng said she noticed the clothing samples in the luggage when she put her personal items in it.

She also testified that her ticket and expenses were paid for by Gomez, who was a clothing supplier, and that no one fetched her at the airport here, adding that she was to stay in a hotel, the address of which was given by Gomez.

Cheng further testified that she was shocked to know that there were things believed to be drugs in a secret compartment of the said luggage during a Customs check at the airport here.

She said she was shocked because she did not know the things were hidden in such way.

Cheng was represented by counsel Ridwandean Borhan and Ram Singh, while Customs Deputy Public Prosecutor Khuzaima Dolfatah appeared for the prosecution.
