Drug trial of car service adviser from peninsula starts

Kota Kinabalu: The trial of a 31-year-old car service adviser charged with trafficking 1,514.7gm of syabu began at the High Court here Monday.Henry Chan Kok Loon, a West Malaysian, is accused of committing the offence at 10.15am on Feb 12, 2015 here.

Deputy Public Prosecutor Aida Fatimah Datuk Abdul Jabar in tendering the opening address told Judge Datuk Nurchaya Haji Arshad the prosecution would prove via oral evidence, exhibits and documentary evidence that Chan had possession of the said drugs.

She said the prosecution would lead evidence to prove that Chan had knowledge of the said drugs and that the possession was not accidental, and in its totality would point to the irresistible conclusion that Chan did traffick the said drugs.

Aida said the prosecution would prove that acting on information, a narcotics raiding team was led to the Kota Kinabalu International Airport's Terminal 2 at 9.10am on Feb 12, 2015 and on arrival, they saw the accused, Chan, lugging a dark chocolate luggage bag towards the car park in front of the terminal.

When the raiding team approached Chan, he was surprised and tried to run away but was arrested.

A body search was conducted on him but the police found no incriminating object. Police also asked him a few questions but Chan remained silent.

Chan and the luggage bag were brought to the State police headquarters.

After a caution under Section 37B of the Dangerous Drugs Act was read to Chan in Mandarin, police proceeded to inspect the luggage bag and found it was padlocked and the zipper of the bag had a combination lock.

Police opened the bag after Chan told them the key to the padlock was in his shirt and also told them the combination number to the lock.

Two golden boxes with Chinese characters containing crystalline substance in plastics were found inside the luggage bag together with clothing and toiletries.

Aida further said they would be calling a chemist to show that the substance confiscated was Methamphetamine (syabu), weighing 1,514.7gm.

The prosecution would be calling about six witnesses throughout the trial, she said.

Chan had on Oct 13, 2015 pleaded not guilty to the charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952 which carries the death penalty on conviction.

He was represented by counsel Ram Singh.
