Farmer pleads not guilty to raping adopted daughter

Kota Kinabalu: A 54-year-old farmer was on Thursday charged with raping his 15-year-old adopted daughter.The man pleaded not guilty before Sessions Court Judge Noor Hafizah Mohd Salim to raping the girl between 1pm and 2pm on June 26, 2015 at a village in Pitas. The man faces between five years and 30 years' jail and whipping, if convicted under Section 376(2)(d) of the Penal Code.

Noor Hafizah fixed May 19 for case management and ordered him remanded on the grounds that there was no special circumstances given by the defence in applying for bail. Earlier, Deputy Public Prosecutor Husna Abdul Halim objected to bail submitting that the alleged victim is the man's adopted daughter and there was high possibility he might tamper with prosecution witnesses.

However, counsel Rahimah Majid who defended the man urged the court to grant bail, saying there was no issue of the man tampering as the girl is currently under the care of the Welfare Department.

Rahimah also informed the court that the man was the sole breadwinner for his wife and six children.

In rebutting Rahimah, Husna said even though the girl is currently at the Welfare Department, the man would still have a chance to tamper with other witnesses such as his wife.In the same court, eight men and a woman were jailed four months each for illegal entry.

All the men were also ordered given a stroke of the cane each.

The court heard that the foreigners were arrested in the city, Penampang, Manggatal and Papar, recently after failing to produce valid documents.

After serving their jail sentence, the foreigners were ordered referred to the Immigration Department.
