PETALING JAYA: All roads fall under the jurisdiction of the law and is subject to enforcement under the Road Transport Act, said the senior traffic police officer. He said motorcyclists must wear helmets whether riding on highways or village dirt roads.

"Earlier, roads were divided into private and public. Now, all roads fall under the law. "The law must be respected regardless of one's status," said the officer who declined to be named. The officer said those found riding without a helmet would be fined under the Road Transport Act.

A police report was lodged against Malacca Chief Minister Datuk Seri Idris Haron who was seen riding a motorcycle without a helmet during his visit to a village in Tehel last Friday.

Kota Laksamana DAP assemblyman Lai Kuen Ban's special officer, Low Chee Leong, 46, lodged the report against Idris for violating traffic rules at Tengkera police station on Wednesday. Idris was seen riding a motorcycle with Bemban assemblyman Datuk Ng Choon Koon. Both were without helmets.

Idris was quoted by a daily as saying the village headman was reluctant to provide him and Ng with helmets upon request and they proceeded to ride without one.

He said his actions were excused as they were travelling on a village road as they were following a group of motorcyclists to the mosque.

Idris said there were several policemen in the area "but as the road was not gazetted, no summonses were issued".

"Let me remind the person who lodged the police report that the village road at Tehel is not gazetted under the traffic ordinance," Idris was quoted as saying.

Motorcyclist and pillion riders who fail to wear safety helmets accounted for the highest number of traffic fatalities in the country.

Based on Bukit Aman Traffic statistics, 39,744 motorcyclists and pillion riders were killed in road accidents between 2005 and 2014.
