Man charged with raping daughter, 12

Kota Kinabalu: A 42-year-old air-conditioner serviceman was charged at the Sessions Court here Thursday with raping his 12-year-old daughter.The Murut man however pleaded not guilty before Judge Ainul Shahrin Mohamad to two counts of committing incest with the girl in December 2015 and February this year in a unit of an apartment in Manggatal.Each count is framed under Section 376(3) of the Penal Code which carries a jail term of between eight years and 30 years and not less than 10 strokes of the cane if convicted.

The man also claimed trial to a third charge of inciting the same daughter to an act of gross indecency at the same place in November 2015.The offence under Section 377E of the Penal Code provides for jail term of up to five years and liability of whipping on conviction.Ainul set June 13 for pre-trial case management and denied the man bail.Earlier, Deputy Public Prosecutor Hafiza Zahidah Abdullah objected to bail on the grounds that it was a non-bailable offence but the man through his counsel Alex Lee, requested for bail.

Sapirin Ahmad had on March 16 pleaded not guilty to committing the offence between 12.40pm and 2.30pm on March 18, 2009 near a helipad at the Fairy Garden in Kundasang.
