Allowing stay for 11 illegals: Firm pleads not guilty

Kota Kinabalu: A construction company was on Wednesday charged with allowing 11 illegal immigrants to stay in its premises.Elite Bay Sdn Bhd, represented by its manager, pleaded not guilty before Sessions Court Judge Ainul Shahrin Mohamad.

The company allegedly permitted the illegal immigrants to stay in the premises between 11.10am and 11.45am on Dec 5, 2015 at the Wawasan Plaza, here.

The offence, under Section 55E(1) of the Immigration Act, carries a fine of between RM5,000 and RM30,000, or a jail term of up to a year, or both, for each illegal immigrant involved and if the foreigners number more than five, the sentence is imprisonment between six months and five years, and whipping.

Ainul set June 27 for case management and ordered the manager to get an approval letter to represent the company during the proceedings.

Prosecuting Officer Hamisa Puteh from the Immigration Department appeared for the prosecution.

In the same court, six foreigners were sentenced to four months' jail each for entering the State without valid documents.

Two of them were also ordered given two strokes of the cane.

After completing their jail sentence, the foreigners were ordered referred to the Immigration Department.

Meanwhile, another man who was charged with entering the State illegally, claimed trial to the charge.

Ainul fixed today (Thursday) for mention of Azmih Elton's case after being informed by the prosecution that they had just received a non-citizen birth certificate from Azmih's family.

Assistant Superintendent of Police Sabrina Jinius told the court that she needed to verify the document with the National Registration Department and thereafter refer the case to the Deputy Public Prosecutor's office.
