Causing hurt while robbing: Duo get 11 years, cane

Kota Kinabalu: Two local men were sentenced to 11 years' jail and ordered to get three strokes of the cane each for causing hurt to a man while robbing him.Melvin Sylester and Aparon Julian, both 26, pleaded guilty before Sessions Court Judge Azreena Aziz to the charge against them on Thursday.

They caused hurt to one Wong Chung Liong while robbing him between 1.30am and 2.30am on June 8, this year in front of a house in Taman Austral Park, Kepayan, here. The offence under Section 394 of the Penal Code carries a jail term of up to 20 years and whipping, on conviction.

After completing their jail sentence, the court ordered them placed under police supervision for two years.

During mitigation, Melvin and Aparon who were not represented begged for leniency saying they have families to look after and that they regretted their offence.

However, Deputy Public Prosecutor Husna Abdul Halim urged the court to impose a deterrent sentence on the grounds that the duo have three previous convictions for theft and drug offences.

In the same court, a Filipina was jailed 10 months for overstaying in the State.

Jane Guipaya Modasi was arrested in the city area after she was found to have stayed in the State after her passport had expired.

Meanwhile, Nursyaqira Masmud, who was arrested on June 9 this year after failing to produce any valid document, was sent to prison for four months for illegal entry.

They were ordered referred to the Immigration Department after serving their jail sentence and their biometric data recorded before their deportation to their own country.
