Car-jacking: Man loses his appeal

Kota Kinabalu: A 30-year-old failed in his appeal against his sentence of 11 years' jail and three lashes of the cane for car-jacking.High Court Judge Datuk Nurchaya Arshad on Friday dismissed Donnie Rohil Damsik's appeal.Donnie had, on May 10 this year, been ordered to serve the sentence by the Sessions Court after he pleaded guilty to taking off with the car while one Nurinah Nuh, 31, and her one-year-eight-month-old child were inside the vehicle at 2.39pm on April 23.

He committed the offence by the roadside near the KK Plaza shopping complex, here.Donnie also made off with a passport, a handphone, a grass-cutter and a car registration card.The offence, under Section 392 of the Penal Code, carries a jail term of up to 14 years and whipping, on conviction. Donnie was not represented while Deputy Public Prosecutor Aida Fatimah Datuk Abdul Jabar appeared as the respondent.

In another case, the court dismissed the appeal by a 41-year-old former clerk of a school against her conviction and sentence of a total of 20 years' jail on five counts of criminal breach of trust involving a sum of RM8,839.20.Nurchaya also dismissed the cross-appeal by the prosecution against the decision of the Sessions Court on Helena Baba.

However, Helena, who was represented by counsel Edward Paul, managed to obtain a stay of execution pending an appeal to the Court of Appeal. Helena was on July 15, 2015 found guilty of committing the offences between Oct 5 and Oct 28, 2005 at the SRS Datuk Simon Fung in Kingfisher, here, between 8am and 5pm.The charges stated that Helena was entrusted with RM1,112, RM336, RM1,120, RM2,984.20 and RM3,287, respectively, but she misused the money for her own.Stay up-to-date by following Daily Express’s Telegram channel.
