26 years and six strokes for raping niece, 14

Kota Kinabalu: A 31-year-old man who raped his underaged niece twice, was sentenced to 26 years' jail and ordered to get six strokes of the cane on Monday.The man who was supposed to stand trial before Sessions Court Judge Ainul Shahrin Mohamad, changed his plea and pleaded guilty to two counts against him.On the first count, the man was jailed 13 years plus three strokes of the cane for raping the 14-year-old girl between 1pm and 2pm in mid-September 2015 at a house in Papar.

On the second count, he was sent to prison for another 13 years and ordered given three strokes of the cane for repeating the offence against the same girl at 9pm on Dec 23, 2015 at the same place.He committed the offence under Section 375(g)/376(1) of the Penal Code which provides for a jail term of up to 20 years and whipping, on conviction.Ainul ordered the man to serve the jail sentence consecutively from the date of his arrest.In handing down the sentence, Ainul said the offence committed by the man was a serious and heinous crime.

She said he is supposed to protect his family members and not commit the offence.Earlier, counsel Goldam Hamid who defended the man, asked for a lenient sentence and that it be served concurrently saying the sexual intercourse was consensual.

Goldam said there was no violence or physical force used during the crime.However, Deputy Public Prosecutor Hafizah Zahidah Abdullah urged the court to impose a deterrent sentence on the grounds that the man had destroyed the victim's future by raping her.Stay up-to-date by following Daily Express’s Telegram channel.
