Raping girlfriend, 14: Filipino gets 12 years

Kota Kinabalu: A 28-year-old Filipino was on Thursday sentenced to 12 years' jail for raping his local underaged girlfriend.

Sessions Court Judge Azreena Aziz handed the sentence to Darussabah Abd Darussalam after he was found guilty of having sex with the 14-year-old girl at 4pm on May 13, 2015 at a rented room in Segama, here.

He was convicted under Section 376(1) of the Penal Code which carries a jail term of up to 20 years and whipping, on conviction.

Darussabah was ordered to serve the jail sentence from the date of his arrest on May 14, 2015 and referred to the Immigration Department after completing his jail sentence.

During mitigation, counsel Datu Baginda Datu Laja who represented Darussabah asked for a minimum sentence saying that he was the breadwinner for his family.


Datu Baginda also told the court that Darussabah had given full cooperation to the police during investigations.

However, Deputy Public Prosecutor (DPP) Husna Abdul Halim urged the court to impose a deterrent sentence on the grounds that Darussabah had had sex with a minor and as an adult person, he should not have taken advantage of her.

Husna also submitted that Darussabah was not a local.

Twelve prosecution and three defence witnesses were called during the hearing.


In another court, a 26-year-old government servant charged with raping his 12-year-old stepdaughter, will go trial on Sept 28.

Sessions Court Judge Indra Ayub set the date for the man who maintained his innocence during pre-trial case management.

The man allegedly raped the girl at 5pm on May 17 this year at a quarters in Beaufort.

DPP Mohd Kahairuddin Idris appeared for the prosecution while the man was represented by counsel Azman Karim.
