Man ordered to enter defence for raping cousin, 14

Kota Kinabalu: A 38-year-old man was ordered by the Sessions Court here on Thursday to enter his defence on a charge of raping his underaged cousin.Judge Azreena Aziz made the order after ruling that the prosecution had established a prima facie case.

The court fixed July 21 for the man's defence. The man is accused of raping the 14-year-old girl at 2.30pm on Nov 6, 2015 and 7am on Nov 7, 2015 at a hotel in Sinsuran Complex, here.

The offence under Section 376(1) of the Penal Code provides for a jail term of up to 20 years and whipping, on conviction.

Deputy Public Prosecutor Muhammad Zuhaili conducted the prosecution.

The prosecution had called eight witnesses during the hearing.

In another court, Sessions Court Judge Indra Ayub set Aug 9-10 this year to hear the case of a 22-year-old man charged with robbery. Muhammad Emir Farriz Yusof maintained his plea of not guilty when his case was brought up for case management.

He allegedly robbed one Mohamad Hazwan Mohamed Yusof of a wallet and a handphone with a machete at 1.20am on March 15 this year in front of a shop in Taman Cantek, Penampang.
