Soldier's appeal against sentence for raping stepdaughter is dismissed

Kota Kinabalu: The High Court here dismissed an appeal by a 34-year-old soldier against his 20 years' jail and 10 strokes of the cane for raping his stepdaughter.Judge Datuk Nurchaya Haji Arshad affirmed the sentence imposed on the man by the Sessions Court here.

The soldier had on March 28 this year pleaded guilty at the Sessions Court to raping his 19-year-old stepdaughter at 12.30am on March 15 this year at a Lok Kawi army camp quarters in Putatan.

The offence under Section 376(3) of the Penal Code carries a jail term of between eight years and 30 years and whipping of not less than 10 lashes.

The soldier had earlier requested for his sentence to be reduced saying that he was remorseful and needed to look after his four children.

Deputy Public Prosecutor Aida Fatimah Datuk Abdul Jabar appeared as respondent.

Meanwhile, in the Magistrate's Court, five men were sentenced for drug-related offences.

Mohamid Mallati, 32, and Laurent John Johnny admitted to having syabu weighing 0.35gm and 0.12gm on May 9 and May 11 this year.

Mohamid was jailed 10 months while Laurent was handed seven months' jail.

The other three, Chan Kuok Siong, Hedwig Jaggum and Lim Chee Kiong pleaded guilty to taking drugs in April.

Chan was sentenced to six months' jail while Hedwig and Lim were fined RM2,000 or six months' jail each.

Chief Inspector Lim Swee Beng prosecuted.
