Kok awarded RM350,000over ISA detention

Putra Jaya: The Court of Appeal on Tuesday allowed Seputeh Member of Parliament Teresa Kok Suh Sim's appeal over her arrest and detention under the Internal Security Act (ISA) in 2008 and awarded her RM350,000 in damages.A three-member bench led by Justice Datuk Abang Iskandar Abang Hashim ruled that former Home Minister Tan Sri Syed Hamid Albar and other respondents had failed to show the court credible and sufficient evidence that the arresting officer had reasonable and substantive grounds to arrest Kok.

The other two judges were Datuk Varghese George Varughese and Datuk Zaleha Yusof.

Justice Varghese who read out the 36-page judgement said provisions in law should not be used by the authorities to harass or intimidate any person but only for purposes that were legitimate to meet the specified objectives.

"Having given our utmost and most serious consideration to matters discussed above, and having taken into consideration the appellant's status and position (Kok), we further ordered the respondents pay the appellant the following damages," he said.

The panel ordered a sum of RM200,000 as general damages, RM150,000 as aggravated and exemplary damages and RM70,000 as costs to be paid to Kok.

The court had also set aside the ruling of the High Court which dismissed Kok's suit against Syed Hamid, former Inspector-General of Police Tan Sri Musa Hassan, DSP E Kim Tien and the Malaysian Government.

On March 13, 2009, Kok filed the suit against the four claiming that she was wrongfully arrested and detained under the ISA.
