'Strata titles with OC' planned

Kota Kinabalu: The issuance of strata titles right upon Occupational Certificates (OC) being obtained on stratified properties is among the amendments being considered by the State Government as part of revisions to the Land (Subsidiary Title) Enactment 1972. Local Government and Housing Minister Datuk Seri Hajiji Hj Noor on Thursday said this was among the amendments he hoped would be approved by the end of this year in resolving the long overdue strata title problems plaguing multi-level residential owners in the State.

"The State Cabinet has sought the State Attorney General's office and the Land and Survey Department to revise the Subsidiary Title Enactment, to allow for the speedy issuance of strata titles.

"Once the revision is done, including the proposed amendments, we will deliberate them at the State Assembly and eventually endorse them," he said during a media luncheon here.

His comments followed the incessant calls of multi-level residential owners, Sabah Housing and Real Estate Developers Association and more recently, MCA member Hiew King Cheu for the State Government to speed up the issuance of strata titles to housebuyers.

Hiew argued that this is because many apartment owners presently only depend on the Sales and Purchase Agreement as proof of ownership of their own units.

According to Hajiji, among the problems involving the issuance of strata titles is when developers carry out their development in phases, whereby strata titles can only be issued to buyers when all the phases are completed and once they settled the land premium.

"The amendments will be approved, depending on how quick the State Attorney General can complete the revision and the proposed amendments," he said.

Hajiji said the revision also include the Building By-Law and Management Corporation, as well as proposed amendments to resolve problems involving developers which are ailing, wound-up or no longer in the State, and also incapable of settling the land premiums for the strata title to be issued under the Land (Subsidiary Title) Enactment 1972.

On another note, he said the ministry could only decide the next course of action on the 1 Sulaman development once the court decides on the appeal of developer, Sagajuta (Sabah) Sdn Bhd.

On June 23, the High Court ordered the company to be wound up, after which the State Government said it was prepared to intervene and resolve the long overdue project completion.
