Two directors charged with RM3.8 million CBT

Kota Kinabalu: Two company directors were charged in the Sessions Court on Tuesday with three counts of criminal breach of trust involving a sum of RM3.831 million.Yong Meau Fah, 59, and Chu Pui An, 56, pleaded not guilty before Judge Ainul Shahrin Mohamad after the charges were read to them.On the first count, Yong and Chu are accused of breaching the trust given to them as directors of Syarikat Globinamas Sdn Bhd who were entrusted with two cheques for RM550,000 at Maybank in Karamunsing here between Jan 11 and Oct 16, 2008.ADVERTISEMENT On the second count, the charge read that they were entrusted with another nine cheques for RM2.156million but allegedly breached that trust at the same place between March 2 and Sept 14, 2009.On the third count, they are accused of committing a similar offence on six cheques for RM1.125million Maybank in Karamunsing here between June 18, 2010 and May 26, 2011.The offence under Section 409 of the Penal Code carries a jail term of between two years and 20 years and with whipping and also liability of a fine on conviction.Ainul released Yong and Chu on a bail of RM150,000 in a local surety each and ordered them to report to the nearest police station once a month with their passports, if any, to be impounded by the court. ADVERTISEMENT The court also warned them to not communicate or contact any of the prosecution witnesses.Their case would be re-mentioned on Sept 28 this year.

Earlier, Deputy Public Prosecutor Akmazatul Mohamed Nawi objected to bail on the grounds that the case involved a huge sum but said if the court were to offer them one, the bail amount must be 10 per cent of the amount involved.Akmazatul also asked the court to impose several strict conditions on them.However, counsel Timothy Daut who appeared together with counsel Viviana Chew, for the duo, asked for a lower amount of bail saying their clients were very cooperative with the police during investigations. Daut also submitted that they were running the company on which a lot of employees were depending on.Meanwhile, in the Magistrate's Court, Yong and Chu were jointly charged with another director with two counts of misusing properties belonging to the same company.On the first count, Mohd Shahril Jaraei, 56, Yong and Chu pleaded not guilty before Magistrate Jessica Ombou Kakayun to misappropriating two vehicles belonging to Syarikat Globinamas Sdn Bhd for the use of the Kota Kinabalu new court complex proposed project handled by Syarikat Techbay Sdn Bhd.The crime allegedly took place at the Kota Kinabalu new court complex site here between 2014 and 2015.On the second count, they allegedly misused eight machinery belonging to the same company for the use of a road upgrading project in Jalan Linuyukan-Pinangah, Sandakan handled by Syarikat Techbay Sdn Bhd between 2011 and 2014.Stay up-to-date by following Daily Express’s Telegram channel.

Both charges stated that Mohd Shahril, Yong and Chu were directors and shareholders of Syarikat Techbay Sdn Bhd.Kakayun fixed Oct 5 for case management and released them on a bail of RM20,000 with RM10,000 deposited in two local sureties each. The court also ordered that the same conditions imposed by the Sessions Court be applied on them.
