Man to go on trial Jan for raping cousin

Kota Kinabalu: A 33-year-old local man charged with raping his cousin will go trial on Jan 19-20 next year.Sessions Court Judge Ainul Shahrin Mohamad fixed the date for the man after he maintained his plea of not guilty when his case was brought up for case management.

Ainul also rejected the man's application for bail through his counsel Henry Gudid and ordered him remanded further pending the date.

The man is accused of raping the 18-year-old girl at 6.30am on Aug 22 this year at the Kg Kibunut cemetery area in Penampang.

The offence under Section 376(1) of the Penal Code carries a jail term of up to 20 years and whipping, on conviction.

Deputy Public Prosecutor Hafizah Zahidah Abdullah appeared for the prosecution.

Meanwhile, in another court, a 28-year-old Pakistani was sentenced to seven months' jail after he was found guilty of entering the State without any document.

Sessions Court Judge Elsie Primus handed the sentence to Adnan Khan Ayub Khan who was found to have committed the offence between 9.50pm and 10.30pm on Feb 29 this year in Kg Likas, here.

Elsie ordered Adnan to serve the jail sentence from the date of his arrest and referred to the Immigration Department after serving his jail sentence.

Prosecuting Officer Hamisah Puteh from the Immigration Department conducted the prosecution while counsel Datuk Chau Chin Tang defended Adnan.
