Judgment against cops in suit

Kuala Lumpur: The widow of N. Dharmendran succeeded in obtaining a High Court judgment against four policemen over his controversial death in a lockup three years ago. Marry Mariay Susay, 28, was granted the ruling by judicial commissioner Datuk Roslan A. Bakar when he allowed her bid to enter Judgment in Default of Appearance against Inspector S. Hare Krishnan, 42, and three other policemen.

The other three were Sergeant Jaffri Jaafar, 46, Corporal Mohd Nahar Abdul Rahman, 47, and Corporal Mohd Haswadi Zamri Shaari, 34. On June 29, the High Court here acquitted the four cops of the murder of Dharmendran, a 32-year-old sewage company worker.

Confirming the outcome when contacted, Melissa said her client's application was allowed because the four policemen failed to enter appearance, by either sending lawyers or themselves, to attend various case managements of the suit, including today's.

Melissa said they failed to attend any case management of the suit despite court papers having been served on them in August. She said she would seek instructions from her client Marry on whether to proceed with assessment of damages against the four.

Melissa said that the other defendants entered appearance yesterday through federal counsel Safiyyah Omar, adding that the court set Oct 13 for further case management of the matter. The other defendants are Assistant Commissioner Yahya Abd Rahman; Superintendent Glenn Anthony Sinappah; Senior Assistant Commissioner Khairi Ahrasa; former Kuala Lumpur Criminal Investigation Division (CID) chief Datuk Ku Chin Wah; federal police CID director Datuk Seri Mohmad Salleh; the Inspector-General of Police, and the government.

The four policemen were assigned to investigate a shooting incident report against Dharmendran, who was detained on May 12, 2013. The victim was allegedly murdered at the Serious Crime Division (D9) office on the seventh floor of the Kuala Lumpur Police Contingent (IPKKL) headquarters in Jalan Hang Tuah, Dang Wangi here, between May 18 and May 21, 2013.

At the time of Dharmendran's death, Yahya and Glenn were the officer-in-charge and deputy officer-in-charge of D9 at IPKKL, while Ku and Khairi were then the city's (Kuala Lumpur) CID chief and CID deputy chief, respectively.

Mohmad was the then Kuala Lumpur police chief.

Marry claimed that Dharmendran was falsely imprisoned, and that the four policemen and four others had engaged in a conspiracy to conceal the truth behind her husband's death, among others.

Among other relief, Marry is seeking damages over the alleged assault and battery of Dharmendran, conspiracy, misfeasance in public office, violation of the defendants' statutory responsibility, and negligence.
