CBT involving RM5m: Father and son among three charged

Keningau: A contractor, a businessman and his son were charged in the Sessions Court here with two counts of criminal breach of trust (CBT) and abetment involving RM5,729,243.97. The contractor, Ahmad Jasad Salali, 54, was accused of committing the CBT by depositing a sum of money meant for road construction projects into his own bank account, while businessman Chai Nyuk Kong, 59, and his son, Chai Ven Pin, 31, were charged with abetting Ahmad in the act.

All of them pleaded not guilty when the charges were read to them before Judge Ainul Shahrin Mohamad.

Ahmad Jasad was charged under Section 409 of the Penal Code which carries an imprisonment of two to 20 years with whipping, and shall be liable to a fine if convicted, while Nyuk Kong and Ven Pin were charged under Section 109 of the Penal Code read together with Section 409 of the same code for abetting Ahmad Jasad and face prison sentence of up to 20 years and fine, if found guilty.

According to the first charge sheet, Ahmad Jasad was alleged to have committed CBT between Oct 31, 2009 and July 2010 by depositing RM5,139,856,77 as payment for road construction projects of Taman Kekal Pengeluaran at 38km, Nabawan, into his account at CIMB Islamic Bank Keningau, when the money should be deposited into the account number (10030011094057) CIMB Islamic Bank belonging to Ahmad JS Construction Sdn Bhd.

On the second charge, Ahmad Jasad was also accused of committing CBT on Sept 30, 2011, by depositing RM589,387.20 as payment for the same project into his account at the same bank, when the money should be deposited into the account number (10030011094057) CIMB Islamic Bank belonging to Ahmad JS Construction Sdn Bhd.

Meanwhile, Nyuk Kong and Ven Pin were both charged with abetting Ahmad Jasad in committing the two CBT offences.

Judge Ainul Shahrin Mohamad set bail of RM200,000 to each of the accused with one surety and ordered them to surrender their passports to the court.

Nov 17 was set for re-mention of the case.
