Immigration officer jailed 36 months, fined RM10,000 for graft

Kota Kinabalu: An immigration officer was sentenced to a total of 36 months' jail and fined RM60,000 by the Sessions Court here on two counts of corrupt practice.AgKu Mohd Shaifful Amp Ag Damit, 44, was convicted and found guilty by Sessions Court Judge Nixon Kennedy Kumbong.Nixon in delivering his decision at the end of the defence, ruled that Shaifful had not cast any reasonable doubt on the prosecution's case.

Shaifful was jailed 24 months and fined RM50,000 or six months' jail for receiving a RM10,000 bribe from one Kent Ng Thien Ming through one Lee Huat Chee @ Peter Lee as an inducement to help Ng with his workers who were arrested by the immigration team.The offence took place between noon and 1pm on Oct 16, 2012 at the Immigration Department in the Federal Administration Complex, here.Shaifful was handed another 12 months' jail and fined RM10,000 or three months' jail on another count of receiving an aquarium valued at RM371 from Ng for a similar purpose between noon and 1pm on Oct 16, 2012 at the same place.The offences under Section 17(a) of the Anti-Corruption Act 1997, carries a jail term of up to 20 years, and a fine of five times the amount involved or RM10,000, whichever is higher.

Nixon ordered Shaifful to serve the jail term consecutively.However, Shaifful managed to obtain a stay of execution of the imprisonment sentence following an application by his counsel but the court ordered that the fine be paid by Monday.
