Kota Kinabalu: A former Sabah Land Development Board (SLDB) General Manager charged with committing criminal breach of trust involving a sum of RM8.9 million will go trial next year.Sessions Court Judge Abu Bakar Manaf set Feb 1-3 and Feb 14-16, 2017 for George @ Juaari Majid, 63, who maintained his plea of not guilty when his case was brought up for case management on Thursday.

George allegedly committed the offence at the SLDB office in Jalan Kelapa Sawit, off Km 4, here between March 22 and Aug 14, 2013.

The charge stated that George, who was the General Manager of SLDB at that time, was entrusted with the money but breached the trust by approving the amount for one How Kim San as land and crop compensation for 410 acres located at Kg Babason, Sook, in Keningau.

He allegedly made the approval without the knowledge and approval of the Board of Directors of SLDB as well as the State Finance Minister as he knew that the land actually belonged to the Sabah government and that How did not have any right to receive the compensation.

The payment was made in four transactions via SLDB's account to How through an account belonging to a law firm.

The offence under Section 409 of the Penal Code carries a jail term of up between two and 20 years, and whipping, and liability of a fine, on conviction.

Abdul Manaf also fixed the same dates to hear How's cases.

How is accused of abetting George in committing the criminal breach of trust at the same place and time.

He is also facing another charge of money laundering, involving the same amount, the crime of which allegedly took place at the Public Bank branch at Keningau Plaza, Keningau, between May 29 and Sept 23, 2013.

The charge stated that How received six cheques for RM3 million, RM950,000, RM546,000, RM2.25 million, RM250,000 and RM2 million through a law firm and banked the cheques into his own account.

Prosecuting Officer Awang Shamsul Baharom from the Malaysian Anti-Corruption Commission stood in for Deputy Public Prosecutor Ahmad Akram.

Counsel Ansari Abdullah and Erveanna Ansari represented George while counsel Sugumar Balakrishnan defended How.
