Contractor claims trial to four counts of cheating

Kota Kinabalu: A 38-year-old contractor was charged in the Magistrate's Court here Tuesday with four counts of cheating a man of RM37,650 over an election project and sale of cars going under the hammer.Mohd Khairul @ Sharul Jaafar pleaded not guilty before Magistrate Stephanie Sherron Abbie to three counts of cheating one Peter D Lee @ Peter Dickie Lee, 66, by making Lee believe that he had acquired a project for the 2013 election from the Federal Government, namely the 1Malaysia Kembara convoy, for which Khairul asked for a payment of RM150 per participant.

Khairul's ruse caused Lee to give him RM3,900 for 26 participants on the first count, RM4,000 for 29 participants on the second count and RM6,750 for 45 participants on the third count.

He allegedly committed the offences at 1pm on Dec 9, 2011, at Maybank Karamunsing; at 11.30pm on Dec 11, 2011 at Palace Hotel in Karamunsing and at 7pm on Dec 13, 2011 at Taman Century, Jalan Penampang.

On the fourth count, Khairul, who appeared before Magistrate Cindy Mc Juce Balitus, claimed trial to cheating Lee into believing that he could get four cars auctioned by the bank, which caused Lee to give him RM23,000 as a deposit.

The offence allegedly took place at 7pm on Dec 13, 2011 at DT 6, Taman Century, Lorong Semangkuk 3, Jalan Penampang, here.

The court set Jan 4 and Jan 18 for mention of Khairul's cases and released him on a bail of RM5,000 in two sureties on each count.

Khairul was represented by counsel Nurul Rafeeqa.

Meanwhile, a 53-year-old government servant also claimed trial to a similar charge of cheating.

Abdillah Nanun is accused of cheating one Hamidah Datu Aliudin, 55, of RM8,700 by making her believe that he can manage an Umrah package at 11.11am on Sept 27 this year at Bank Islam in Karamunsing.

Magistrate Jessica Ombou Kakayun fixed Dec 6 for mention and offered Abdillah on a bail of RM2,000 in two sureties.

Khairul and Abdillah were charged under Section 420 of the Penal Code which provides for a jail term of between one and 10 years, and whipping and fine, on conviction.

Chief Inspector Lim Swee Beng, Inspectors Azaman Hamat and P. Nathan prosecuted.
