Man jailed, fined RM10,000 for bribing traffic cop

Kota Kinabalu: A 46-year-old man was jailed one day and fined RM10,000 in default a month behind bars for giving a bribe of RM200 to a traffic police officer. Sessions Court Judge Abu Bakar Manaf handed the sentence to Perangki Kindi after he pleaded guilty to the charge against him on Tuesday.

Perangki gave the money to Assistant Superintendent of Police Daniel Dominic as an inducement to not take action against him for using a private vehicle as a public transport.

The offence took place at 7.33pm on June 15 this year at the Traffic Enforcement and Investigation Division office, here.

The offence under Section 17(b) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 provides for a jail term of up to 20 years and a fine of not less than five times the amount of bribe received or RM10,000, whichever is higher.

In handing down the sentence, Abu Bakar said he understood that Perangki needed a side income to support his family but that he should not simply give bribes to the police as it would just give him more trouble.

"If you get summoned, just accept it and settle it properly through the legal system … but not settle it by giving bribes to the police.

"I sympathise with you … I know you just want to earn a side income in supporting your family due to the high cost of living nowadays but the provision under this offence is already there, I have to do my duty," he said.

During mitigation, Perangki asked for a lenient sentence saying that he has six children to look after and that his wife does not work.

He told the court that he was forced to use the private van as a public transport as he needed to earn some side income.

In a related case, another man was sent to prison for one day and ordered to pay a fine of RM10,000 in default a month's jail for offering a bribe of RM200 to Daniel.

Danty Isrin admitted to committing the offence at the same place and time, also for the same purpose which was to not take action against Perangki who committed the traffic offence.

MACC Prosecuting Officer Awang Shamsul Baharom urged the court to impose a deterrent sentence to give a warning to the public at large to not bribe public servants to avoid action taken against them.
