Filipino, 37, claims trial to murder

Kota Kinabalu: A 37-year-old Filipino labourer claimed trial at the High Court here Thursday to murdering another Filipino.Ismail, who holds the IMM13 document, is accused of committing the offence on one Md Adzmar Alex, 19, also an IMM13 holder at 11.30pm on May 1 this year at Kampung Rampayan in Manggatal.Judge Datuk Nurchaya Hj Arshad set Jan 9 next year for pre-trial case management.

Ismail faces the death penalty if convicted under Section 302 of the Penal Code.He was represented by counsel Ram Singh together with YS Lo and Farawzin Hexdy.Meanwhile, the court fixed Jan 25 next year to deliver its decision on a 32-year-old Indonesian accused of murdering his girlfriend in Kundasang, Ranau.Nurchaya set the date after Menase Ladang closed his case after giving his defence under oath.

Menase had on Dec 2 ordered to enter his defence on a charge of murdering one Hamidah Laka, 29, at 1.30pm on Oct 20, 2014 at a vegetable farm in Mesilou.Menase, who was represented by counsel Mohd Syahirulrazi Mohd Jaini, in his testimony, denied committing the offence.

He told the court that prior to the incident, a heated argument ensued between Hamidah and him in relation to their relationship as Hamidah was upset after he had refused to marry her due to their different faiths.Menase testified that Hamidah tried to cut his neck with a knife which led to a struggle between them and that Hamidah was injured during the struggle.He added that they had been in a relation for more than a year before Hamidah kept asking him to marry her.Stay up-to-date by following Daily Express’s Telegram channel.
