Filipino gets three years, 3 strokes for molesting British woman

Kota Kinabalu: A 19-year-old paperless Filipino who molested a young British woman during a massage session was jailed three years and ordered to get three strokes of the cane.

Magistrate Stephanie Sherron Abbie handed the sentence to Faizal Sintaan after he pleaded guilty to the charge against him on Wednesday.

Faizal had molested the 18-year-old tourist by fondling her breasts, caressing her private part, hugging her as well as kissing her neck at 7pm on Jan 4 this year at the Relax Beauty Corner and Reflexology in Centre Point Sabah, here.

He committed the offence under Section 354 of the Penal Code which provides for a jail term of up to 10 years, or with whipping, and liable to a fine, or any two of the punishments, on conviction.

Abbie ordered Faizal to serve the jail sentence consecutively with the four months' jail sentence imposed by the Sessions Court for entering the State illegally.

After completing his jail sentence, he was ordered referred to the Immigration Department.

During mitigation, Faizal who was not represented, asked for a lenient sentence and for it to be served concurrently.

However, Assistant Superintendent of Police Sabrina Jinius urged the court to impose a deterrent sentence on the grounds that it was a serious offence which involved a tourist.

Jinius also submitted that the victim was traumatised by the incident as a result of which she might think that this country is not a safe place to visit.

The court heard that on that day the victim had gone to the reflexology centre to get a massage after going hiking in Telipok.

During the massage session, Faizal molested the victim and shocked and frightened by what happened, she fled the room to the counter to make payment before leaving the centre barefooted and in tears.

She alerted her parents who at the time had gone to a restaurant for dinner and they later took her to the Karamunsing police station to lodge a report.
