Insulting cop's modesty: Tian Chua's fate to be known Feb 13

PETALING JAYA: The Sessions Court here set Feb 13 to decide on the case of PKR vice-president Tian Chua who was charged with insulting the modesty of a police officer using foul words three years ago. Judge Yasmin Abdul Razak set the date after hearing the submissions from both the defence and prosecution.

Earlier, lawyer Latheefa Koya representing Tian Chua, whose real name Chua Tian Chang, 54, appealed to the court to acquit and discharge her client of the charge on several grounds, including the fact that the words allegedly uttered by the accused did not meet the elements under Section 509 of the Penal Code.

Latheefa said the words had neither mentally nor emotionally affected the victim.

However, deputy public prosecutor Suhaimi Ibrahim insisted for Tian Chua to be convicted with the charge on grounds that the words uttered by the accused had clearly insulted the modesty of the police officer.

"In fact, anyone, including myself, would feel insulted if those words were said to our face," said Suhaimi.

On Aug 12, 2014, Tian Chua, who is also Batu Member of Parliament, pleaded not guilty to a charge of insulting the modesty of DSP Glenn A. Sinappah.

He was alleged to have committed the offence the main entrance of Armada Hotel at 7.45 pm on April 14, 2014.

The charge under Section 509 of the Penal Code carries a maximum jail term of five years, or fine, or both, upon conviction.

Throughout the trial, the prosecution called five witnesses, while the defence called two.

Meanwhile, in GEORGE TOWN, the Sessions Courts here Monday fixed March 22 for mention of two cases involving a personal bodyguard charged with attempted murder by firing a firearm at five people on the Penang Bridge last year.

In the first case, Judge Roslan Hamid set the date after the prosecution, conducted by deputy public prosecutor Nurul Huda Idris, requested for a new date pending medical reports on the victims and from the chemist.

In the case before Roslan, Ja'afar Halid, 37, was charged with three counts of attempted murder by shooting at K. Arivani, 33; Nurul Huda Ab Aziz, 38, and Lee Hong Boon, 56.

The offences were committed at the exit to the Penang bridge on Tun Dr Lim Chong Eu Expressway here between 7.15pm and 7.30pm on Dec 1 last year. – Bernama
