Misusing firm's properties: Remention of trio's case on March 13

Kota Kinabalu: Two company directors and another man who were jointly charged with two counts of misusing properties belonging to a company, will have their case re-mentioned on March 13 this year.Magistrate Stephanie Sherron Abbie fixed the date for Yong Meu Fah, 60, Chu Pui An, 47, and Mohd Shahril Jaraei, 50, pending the outcome from the Deputy Public Prosecutor's (DPP) office on the representation letter submitted by the defence.

DPP Omar Faiz Abdul Kahar informed the court that the prosecution had just received the letter from the defence on Tuesday and that they needed time on the matter.

On the first count, the trio are accused of misusing two vehicles belonging to Syarikat Globinamas Sdn Bhd for the use of the Kota Kinabalu new court complex proposed project handled by Syarikat Techbay Sdn Bhd.

The crime allegedly took place at the Kota Kinabalu new court complex site here between 2014 and 2015.

On the second count, they allegedly misused eight machinery belonging to the same company for the use of a road upgrading project in Jalan Linuyukan-Pinangah, Sandakan handled by Syarikat Techbay Sdn Bhd between 2011 and 2014.

Both charges stated that Mohd Shahril, Yong and Chu were directors and shareholders of Syarikat Techbay Sdn Bhd.

The offence under Section 403/34 of the Penal Code provides for a jail term of up to five years, and whipping or liability of a fine, on conviction.

All of them who were represented by counsel Ram Singh are currently on bail pending disposal of their case.

In another case, the court fixed Feb 16 for further mention on the case of a 31-year-old security guard who was charged with misappropriating someone else's property.

Mohd Fairul Maidin is accused of misusing a motorcycle belonging to one Safar Julong on Oct 28, 2015 at Menara Tun Mustapha.

Earlier counsel Farazwin Haxdy who represented Mohd Fairul told the court that the complainant of the case was supposed to testify to explain why he was not interested to procced with the case but he (complainant) was absent on Wednesday.

Farazwin informed the court that there was a new development on the case as she had received a letter through WhatsApp from Mohd Fairul's mother on Jan 20 this year.

She said the letter stated the outcome on the representation letter forwarded to the DPP's office in Putrajaya by a lawyer who is a relative of Mohd Fairul, for Mohd Fairul be given a discharge not amounting to an acquittal.

The court however adjourned the case and ordered Prosecuting Officer, Inspector James Paran to check the matter with the DPP's office here. – Cynthia D Baga
