Imitation guns: Two friends jailed, fined

Kota Kinabalu: Two friends were jailed a day and fined a total of RM9,000 by the Magistrate's Court on Thursday for having imitation guns in Tuaran last month.Locals Weilster Thomas Stephen, 24, and Roddy Sintih, 28, pleaded guilty before Magistrate Cindy Mc Juce Balitus to the charges framed against them.

Unemployed Weilster was sentenced to a day's jail effectively from Thursday and fined RM3,000 or six months' jail for having two replica pistols at 1.30am on Jan 15 this year at the roadside in front of the Education Office in Tuaran.

He was also handed another one day jail and fined RM3,000 or six months' jail on the second count of having another imitation gun at 6.20am on the same day in a house at Kg Pendamai, Tuaran.

The court ordered Weilster to serve the jail term concurrently.

Meanwhile, Roddy was also sentenced to a day's jail and fined RM3,000 or six months' jail for having an imitation sniper rifle and also an imitation silencer at 5.20am on Jan 15 in a house at Kg Togop, Tamparuli.

Assistant Superintendent of Police (ASP) Sabrina Jinius, prosecuting, told the court that Weilster was detained by police after being spotted in a suspicious looking car and on inspection, police found the two replica pistols in the boot of the car.

Later at 6.20am the same day police went to Weilster's house and found the other imitation gun in his bedroom.

Jinius further said that in Roddy's case, police acting on information went to his house and after searching, found the imitation guns there.

Weilster's counsel Datuk Norbert Chin requested for a lenient fine telling the court that the reason for Weilster having the imitation guns was for airsoft games as he was jobless and felt bored staying in the house all the time.

Chin said the airsoft games using the alleged imitation pistols were not dangerous and could not kill anyone as it was only a game.

Weilster regretted his act and promised not to repeat the same offence in the future, said Chin.

Counsel Ariel Dasan acting for Roddy also applied for leniency on the grounds that he is Weilster's friend and they both had the imitation weapons as a hobby.

Roddy now knows that having imitation guns is against the law, added Ariel.

Jinius, applied for an adequate sentence and applied for the imitation guns to be disposed by the prosecution.

Weilster and Roddy were separately charged under Section 36 of the Arms Act 1960 which provides for a jail term of up to a year and fine of up to RM5,000 or both on conviction.

In another case, a man, Vitalis Kuibin, was jailed seven months for having 0.08gm of syabu at 5pm on Dec 23, 2016 at Kg Sugud in Penampang. - Jo Ann Mool
