Murder: 8 men get discharge not amounting to acquittal

SHAH ALAM: Eight men were given a discharge not amounting to acquittal by the High Court here Wednesday on a charge of murdering a security guard two years ago.Judicial Commissioner Wong Teck Meng granted them the discharge after allowing the application by the prosecution represented by Deputy Public Prosecutor Mohd Josiendra Abu Senin.

Earlier, Mohd Josiendra had informed the court that the prosecution had received and considered the representation submitted by the defence.

M. Yugaraj, 28; B. Saravanan, 35; N. Mageswaran, 27; N. Yogeswaran, 24; U. Kunalan, 24; C. Reshiwaran, 24; E. Sasikumar, 28, and S. Dhasan, 27, together with several others still at large, were charged with causing the death of Muhammad Ridhzuan Che Bi, 26, by slashing the victim with a machete.

They were charged with committing the offence at the guard house of 11-Avenue, Persiaran Sungai Keramat, Jalan Rodat 1/KU5, Bandar Bukit Raja, at 2am on April 18, 2015.

The charge under Section 302 of the Penal Code read together with Section 149 of the same code carries the mandatory death sentence upon conviction.

Yugaraj was represented by counsel Balvinder Singh while the rest were represented by counsel V. Rajehgopal.

According to media reports, Muhammad Ridhzuan, who was married for two months, was killed while six other security guards were injured after three guard houses in the area became the target of the attack by the group. – Bernama
