Cheating: Court clerk freed

Kuala Lumpur: A court employee breathed a sigh of relief after being acquitted and discharged by the Magistrate's Court here, Thursday on cheating a mother of an accused over a fine in a court case amounting to RM4,000, two years ago.Magistrate Nur A'minahtul Mardiah Md Nor made the decision concerning a clerk, Shahnaz Khan Kamarzaman, 36, after finding that the prosecution had failed to raise reasonable doubts on the defence case.
Nur A'minahtul Mardiah in her decision said that it was not safe for the court to convict the accused on the charge.

On Jan 10, the High Court ordered the accused to enter his defence to the cheating charge after the court found a key element that Shahnaz Khan had deceived the victim to hand over the money by giving her a fake receipt and making the victim believe that the amount was made for the payment of a fine.
Judge Datuk Azman Abdullah, however, dismissed the prosecution's appeal against the decision and freed Ahmad Mustakim Abdul Halim, 28, a court cashier, who was accused along with Shahnaz Khan and upheld the decision of the Magistrate's Court on June 3, 2016.
Shahnaz Khan and Ahmad Mustakim were charged with cheating Che Su Abdullah, 59, a housewife by duping the victim into believing that they could help her to pay the fine of RM4,000 for a drug case involving her son, prompting Che Su to hand over the money to them.
