5 JCs fail to become High Court Judges

Putra Jaya: At least five Judicial Commissioners (JCs) were not elevated to High Court Judges over the last five years because they failed to meet the criteria of the Judicial Appointments Commission (JAC).Chief Justice Arifin Zakaria (pic), who is also JAC Chairman, declined to offer more specific reasons why the judges on probation failed to make High Court judge.

"There were various reasons but I cannot disclose them," Arifin told reporters after witnessing the appointment of 11 JCs here.

Arifin became JAC Chairman following his elevation to Chief Justice in September 2011.

Arifin said the JAC met once a month to evaluate the JCs who were on probation for two years.

"They have to meet our criteria, such as delivery of judgments.They must perform and there are no two ways about it."

The criteria for selection of judges to the High Court, Court of Appeal and Federal Court, as listed by Section 23 of the JAC Act 2009, are: integrity, competency, and experience; objectivity, impartiality, and fair and good moral character; decisiveness, ability to make timely judgments, and good legal writing skills; industriousness and ability to manage cases well; and sound physical and mental health.

Earlier in his speech, Arifin said judges were entrusted with the heavy responsibility of dispensing justice with wisdom because their rulings determined the fate of the litigants.

"More than that, a court judgment could take away the rights and liberty of a person."

Arifin said judges must equip themselves with knowledge and keep abreast of the times.

"This is to ensure the law in the country develops in accordance with the rule of law."

Meanwhile, the 11 in the Judicial and Legal Service and in private practice who will serve in the High Court of Malaya and Sabah and Sarawak are Rohani Ismail, Dean Wayne Daly, Mat Ghani Abdullah, Asmadi Hussin, Zalita Zaidan, Ahmad Kamal Md Shahid, Anselm Charles Fernandis, Mohd Ivan Hussein, Ahmad Shahrir Mohd Salleh, Bexter Agas Michael and Celestina Stuel Galid.
