Kota Kinabalu: Parti Cinta Sabah (PCS) rejects the proposed amendment to the Syariah Courts (Criminal Jurisdiction) 1965, or better known as Act 355, as put forward by PAS President Datuk Seri Abdul Hadi Awang. Its Information Chief Ramdi Indang said the Act goes against the spirit of the Malaysia Agreement 1963, which guarantees freedom of secular government in the federation and secondly, it could create a conflict when it comes to meting out justice to Sabahan Muslims.

"The proposed amendment, if it goes through, means it would upgrade the jurisdiction of the Syariah court.

But it would also mean then that there will be two sets of rules, and if an offence is committed and it falls under both rules, so an offender could probably choose to be persecuted under either rules?" he said.

This, he said, goes against the principle of equality and equal protection guaranteed under the Federal Constitution.

He added that thanks to Parti Bersatu Sabah (PBS), Syariah Law had become the governing law for all Sabahan Muslims since 1989.

"But it does not mean we should just roll over and take whatever they throw at us without question now.

Having our Muslim friends governed under two laws is bad enough.

"I am not trying to stoke fear among the non-Muslims, but imagine if what happened in Aceh, where a non-Muslim woman was caned for selling alcohol, happened here?" he said.

As a party committed to fighting for the rights of all Sabahans through the Malaysia Agreement 1963, Ramdi said PCS is firm in its stand against any amendment to the Act 355.

"Even though some people would tell us off, saying we should not meddle in their business, let me tell them that Malaysia Agreement 1963 is our business and trying to dance their way around the agreement just so they could appear more pious, makes their agenda our business also," he said. - Tracy Patrick
