Incest case ruling April 26

Kota Kinabalu: A 36-year-old will on April 26 this year get to know whether he has a case to answer on a charge of raping his 12-year-old daughter.Sessions Court Judge Marlina Ibrahim set the date for the man when the prosecution closed its case after calling six witnesses.The man is accused of committing incest with his daughter at a house in Kota Belud on Aug 28, 2013.

He was charged under Section 376(3) of the Penal Code, which carries a jail term of between eight years and 30 years, and whipping of not less than 10 strokes, on conviction.Deputy Public Prosecutor Akmazatul Mohamed Alwi conducted the prosecution while the man was unrepresented.Meanwhile, in another court, a man was ordered to undergo a month of community service for polluting outside his premises in Bandaran Berjaya, here.Sessions Court Judge Ainul Shahrin Mohamed gave Mohd Zulfikar Jefry, 21, the directive under the Compulsory Attendance Order (CAO) for four hours of community service a day with RM10,000 deposited.

The CAO, which is provided for under the Offenders Compulsory Attendance Act 1954, is an alternative to imprisonment imposed by the court on offenders without affecting their lives in the community.Zulfikar pleaded guilty to the offence under Section 6 of the Kota Kinabalu City Anti-Litterbug By-law 2005, which provides for a fine of up to RM10,000 and a fine of RM500 per day if the person continues to commit the offence.
