Fined RM9,000 for selling WiFi adapter without cert

Kota Kinabalu: A company and its directors were fined a total of RM9,000 for selling a WiFi adapter which was not certified by the Standards and Industrial Research Institute of Malaysia (Sirim).Sessions Court Judge Noor Hafizah Mohd Salim handed the sentence to ACI Technology Sdn Bhd, Kong Yin Siong and Wong Soon Fah, both directors of the company on Tuesday.

The company represented by Wong, was ordered to pay a fine of RM5,000 in default two months' jail, while Kong and Wong were fined RM2,000 or spend 60 days in prison each.

The company and the directors were found selling the equipment at the Suria Sabah Shopping mall at 5.50 pm on Oct 23, 2013.

The offence under Regulation 16(1)(b) of the Communication and Multimedia (Technical Standards) 2000 and punishable under Regulation 37 of the Communication and Multimedia which provides for a fine of up to RM100,000 or a jail term of up to six months, or both.

Kong and Wong asked for a minimum fine to be imposed on them and their company saying that it was their first offence since they commenced their business in 2006.

They also promised to take more precautions in the future to avoid such mistakes.

However, Deputy Public Prosecutor Mohd Sophian from the Malaysian Communication and Multimedia Commission asked the court to hand down an appropriate sentence as a lesson to them and public at large to sell and buy only equipment certified by Sirim.

He emphasised that the equipment should be certified to ensure the safety of users.

The company and the directors paid the fine.

In another court, a 21-year-old man was ordered to perform 60 hours of community service for a year for breaking into a house.

Magistrate Stephanie Sherron Abbie made the order on Rahmat Abdullah who maintained his plea of guilt to trespassing the house belonging to one Awangku Azanul Azhar at 10.50pm on Jan 4 this year at Kg Sipanggil, Penampang.
