Kota Kinabalu: The High Court here sentenced a Filipino Cagayan to eight years' jail on Wednesday for smuggling 16 illegal immigrants into the country.Judge Ravinthran N.Paramaguru meted out the sentence to Saring Osman, 44, for transporting the illegal immigrants from the Philippines in a vessel at 1.10am on Feb 6 this year at Tanjung Berungus, off Kudat waters.

He ordered Saring to serve the sentence from the date of his arrest and also ordered the vessel used in the commission of the offence forfeited to the government as applied for by the prosecution.

Saring had on April 25 pleaded guilty to committing the offence under Section 26A of the Anti-Trafficking in Person and Anti-Smuggling of Migrants Act (Atipsom) 2007 which carries a jail term of up to 15 years, or fine, or both, on conviction.

According to the facts of the case, the Malaysian Maritime Enforcement Agency (MMEA) stopped a vessel from Cagayan island to Kudat boarded by a skipper, two crew and 16 passengers.

Further investigation revealed that a man, Saring, was smuggling and transporting the 16 who had no valid documents to enter the country and that Saring charged them a fee to ferry them here.

Deputy Public Prosecutor (DPP) Muhammad Fazlan Mohd Noor stood in for DPP Nurun Nazifah Muhammad Iyen from the MMEA.
