Masturbating before a woman: Man jailed 15 months

Kota Kinabalu: A 40-year-old jobless man who masturbated in front of a woman as she sat in her car outside a shophouse in Penampang, will have to spend 15 months in prison.Rosmadi Sali on Thursday pleaded guilty in the Magistrate's Court to flashing his private parts at the 25-year-old woman with the intention to insult her modesty at 9.30am on May 2 this year at the parking area of Plaza 333, Penampang By-pass.

When asked by the court why he did so, Rosmadi said he lost his composure as he was drunk at that time.

He requested for leniency saying he has seven children, two of them disabled and promised not to drink and commit a similar offence in the future.

Magistrate Jessica Ombou Kakayun, in meting out the sentence, noted that such cases have become frequent recently but never brought before her until now.

The sentence will serve as a lesson to people outside, she said, in ordering Rosmadi to serve the sentence from the date of his arrest.

Earlier, prosecuting officer Inspector Rasydan Jasni, in presenting the facts of the case, said at first, the woman saw an unknown man wandering outside a shop where she works.

Later, while the woman was still in her parked car, she saw the man approaching her car, stand on the left side of her car, unzip his trousers, flash his genitals and masturbate.

He left after he was finished.

The woman recorded the incident and when she checked on the shop's CCTV recording, discovered that it was the same man who had committed a similar act at the shop's entrance on April 27 the same year.

Rosmadi was arrested by police on May 18.

He was charged under Section 509 of the Penal Code, which carries a jail term of up to five years or fine, or both, on conviction.

Meanwhile, Rosmadi is also facing another charge of taking drugs for the third time.

However, no plea was taken from him pending the chemist's report.

The court fixed June 20 for mention.

In another case, 19-year-old Shahrizan Hen admitted to having a stolen gas cylinder at 6pm on May 18 in a Manggatal village.

The court, however, deferred sentencing to June 21 while waiting for Shahrizan's social report being prepared by the Welfare Department.

Shahrizan could be jailed between six months and five years or fined on conviction. - Jo Ann Mool
