Advice not to publish these health service ads

Kota Kinabalu: Publishing houses have been advised not to carry advertisements promoting health services offered by Wo Chinese Medicine and Qigong Sdn Bhd as those ads violated the Medicine Act (Advertisement and Sales) 1956.In a statement released by the State Health Department on Thursday, Traditional and Contemporary Medicine Division Chief Ho Ching Ching said subject to this Act, no person shall take part in the publication of any advertisement

- which refers to any skill or service relating to the treatment, prevention or diagnosis of any ailment, disease, injury, infirmity or condition affecting the human body; and

- which is capable of including, or which contains an invitation, whether express or implied, to, any person to seek advice of the advertiser or any person referred to in the advertisement in connection with such skill or service.

Moreover, Ho said the advertisement on 20 chronic diseases without the approval of the Medicine Advertisement Board is an offence under Section 3 of the same Act.

"These 20 chronic diseases are kidney failure, heart disease, diabetes, epilepsy, paralysis, tuberculosis, asthma, leprosy, cancer, deafness, drug addiction, hernia, eye problem, high blood pressure, mental problem, sterility, frigidity, low sex drive, herpes and sexually transmitted diseases."

Under the Act, offenders could be fined up to RM3,000 or imprisoned a year for first time offenders with subsequent offences punishable by fines of up to RM5,000 or two years' imprisonment.

The statement was released after two local daily newspapers published the advertisement in their publications on Thursday.

Both newspapers were advised to stop the publication of the advertisement immediately.
