Cop to enter defence on three terrorism charges

Kuala Lumpur: A 30-year-old police lance corporal has to enter his defence on three charges, including one on withholding information on terrorism.High Court Judge Justice Nordin Hassan ordered L/Kpl Mustaza Abdul Rahman to make his defence on three counts of amended charges as the prosecution had established a prima facie case against him.

"The accused failed to give information (on terrorism) to his superior. An expert who took the stand also said that bai'ah (loyalty pledge) is evidence of support to the militant group," the judge said.

L/Kpl Mustaza was accused of knowingly giving support to terrorist activities involving use of explosives with intention to further an ideology through the Telegram app.

The offence was allegedly committed at Unit G7-1-1 Blok Iksora, Kuala Muda District Police Apartments, Sungai Petani, between June 28 and 29, last year.

For the second amended charge, he was accused of having knowledge of terrorism-related offences but left out such information to his superiors when he was obligated to do so by law. He allegedly committed the offence at the same place between April and July 29, 2016.

For the third charge, the accused allegedly gave support to Islamic State by pledging his loyalty (bai'iah) through the Telegram app in the group chat named "Gagak Hitam".

The offence was allegedly committed at the same place at 12.25am on March 30, 2016.

The court fixed July 24 and 25 for case mention.

DPP Muhammad Fadzlan Mohd Noor prosecuted while the accused was represented by lawyer Faizal Rahman.

Meanwhile, a former college student was sentenced to a total of 15 years' jail by the High Court here Wednesday after he pleaded guilty to three counts of indirectly dealing with terrorist property.

Judicial Commissioner Datuk Ab Karim Ab Rahman handed down the sentence, of five years on each count, on Hasrianto Matan, 21, to be served concurrently from the date of arrest which was July 17, 2016.

He was charged with committing the offence by depositing RM300, in three transactions, into a Maybank account belonging to one Bukhori Che Noor for the benefit of a terrorist by the name of Muhammad Wanndy Mohamed Jedi (Wanndy).

The offence was committed on April 4, May 1 and June 5, 2016 at the USJ Maybank branch, Subang, Petaling Jaya, Selangor.

The charges were made under Section 130Q(1) of the Penal Code which provides an imprisonment for up to 30 years, or with fine, and shall also be liable to forfeiture of any property so dealt with.

According to the facts of the case, Hasrianto joined the Islamic State terrorist group through the telegram application and communicated with Wanddy through the WhatsApp application.

Following a check with Maybank, it was found that the account number that appeared on the transaction slips that were seized belonged to Bukhori, who had been instructed by Wanndy to manage and collect the fund from members in the "gagak hitam" telegram group.

In mitigation, lawyer Faridah Mohamed, who represented Hasrianto, said it was her client's first offence and that his initial contact with Wandy was merely to know what was happening in Syria.
