Man claims trial to assaulting brother-in-law

Kota Kinabalu: A 49-year-old local was charged with causing grievous hurt to his brother-in-law.Danny Baray pleaded not guilty before Sessions Court Judge Egusra Ali to the charge against him on Thursday.

He is accused of assaulting one Martin Indang grievously with a hammer at 5pm on Feb 27, this year in a house in Kg Batangan, Tuaran.

The offence under Section 326 of the Penal Code carries a jail term of up to 20 years and whipping, on conviction.

Deputy Public Prosecutor (DPP) Khairuddin Mohd Idris objected to bail for Danny on the grounds that he is staying in the same village as Martin. He added that the alleged incident resulted in serious injuries to Martin.

However, Danny who was not represented, asked for bail.

The court set Aug 28, this year for case management and released Danny on a bail of RM5,000 in two local sureties.

In another court, the sentencing of a 23-year-old Filipino charged with robbing a woman was postponed to Aug 28, this year pending the availability of a Filipino interpreter. Sessions Court Judge Ainul Shahrin Mohamad set the date for Edwin Ali, who was supposed to be sentenced on Thursday, after he pleaded guilty to the charge against him during the previous proceedings. But Edwin, who could not really understand Malay, said he needed a Filipino interpreter.

Edwin allegedly robbed one Jayelien Paugin, 31, of her gold necklace at 9.15am on June 21, this year at the Maybank building in Lintas Square, here.

Pending the date, Edwin was ordered remanded further.
