Father, son, soldier get 22 years' jail for manslaughter

Kuala Lumpur: A father and son, and a soldier were sentenced to 22 years in jail by the High Court here Thursday for manslaughter involving a 48-year-old company manager, last year.Ahmad Bohari Mohamad Noor, 52, his son Muhamad Haire Ahmad Bohari, 24, and soldier Ahmad Saipunizam Mohd Pirus, 36, were found guilty of causing Liew Han Yuen's death at PPR Kg Limau, Pantai Dalam, here, between 11.40pm on April 14 and 1.30am on April 15, 2016.The charge under Section 304(a) of the Penal Code carries a maximum jail term of 30 years and a fine, on conviction.

Judicial commissioner Datuk Mohamad Shariff Abu Samah, in meting out the 22 years' punishment to each of the three men, held that the defence had failed to raise a reasonable doubt against the prosecution's case. The judge said the heavy sentence should serve as a lesson to the trio, who were defended by counsel Saiful Zulhelmi Zulkifli and Adi Zulkarnain Zulkafli, as well as to others."The three accused took the law into their own hands. What they did was a serious and grievous crime. The court also takes into account the fact that the victim had ended his future, and injuries could be seen all over his body," the judge noted.

He added that the three accused had acted beyond human rationale and to their own detriment.Earlier, deputy public prosecutor Ahmad Nazneen Zulkifli said whatever decision that the judge might make would not bring the victim back to life.
