Oct trial for bouncer in teen's murder

Kota Kinabalu: A 29-year-old local bouncer charged with the murder of a teenage boy outside a pub in Asia City here last year will go on trial on Oct 9-12 this year.High Court Judge Datuk Nurchaya Hj Arshad fixed the date for Mohd Azmin Lidin during mention of his case before her on Tuesday.The court also set Sept 18 for final pre-trial case management.ADVERTISEMENT Mohd Azmin of Kg Cenderamata, Likas had on Aug 3 claimed trial to committing the crime to one Yaacob Nasran between 3.30am and 4.30am on Dec 15, 2016 outside the Siam Thai Bar at Asia City.He faces the death penalty if convicted under Section 302 of the Penal Code.Deputy Public Prosecutor (DPP) Gan Peng Kun appeared for the prosecution while Mohd Azmin was represented by counsel Dato Seri Rakhbir Singh.Meanwhile, the trial of a 28-year-old cook charged with two counts of trafficking cannabis began on Tuesday.ADVERTISEMENT Noel Harry Hungan is accused of trafficking 2,811gm of cannabis at 5.40pm on May 10, 2016 near the toilet area at the Poslaju office here and allegedly trafficking 3,768gm of cannabis at 10.45am on May 11 the same year at the Air Asia Cargo area here.He faces the death penalty if found guilty on the first and third count framed under Section 39B (1)(a) of the Dangerous Drugs Act (DDA).

DPP Gan among others informed Nurchaya that the prosecution would rely on Section 37A of the Dangerous Drugs Act to invoke the presumption provided under Section 37(d) of the same Act to show that Noel was found to have had in custody of the parcels that contained the dangerous drugs and therefore, be deemed to have been in possession and knows the nature of such drugs.Stay up-to-date by following Daily Express’s Telegram channel.

The prosecution would further show that the totality of the evidence would point to the irresistible conclusion that Noel did it in his own behalf in trafficking in the said drugs, said DPP Gan, who would be calling about seven witnesses.Noel, was represented by Rakhbir. - Jo Ann Mool
