Fined for having air rifle

Kota Kinabalu: A 26-year-old local was fined RM4,000 or eight months' jail Thursday for having a handmade air rifle.Unemployed Castor Eusebio S Majanggon pleaded guilty before Magistrate Jessica Ombou Kakayun to having the weapon without a licence at 6pm on Sept 9, 2016 in a room of a unit at Taman Jaya Diri, in Sepanggar.

The offence under Section 8(a) of the Arms Act 1960 carries a jail term of up to seven years or a fine of up to RM10,000, or both, on conviction.

In mitigation, counsel Henry Gudid, representing Castor, told the court that the weapon did not belong to Castor as it was handed to him by a person who instructed him to send it to another person in the city to be sold.

Gudid requested for a non-custodial sentence for his client, saying it was Castor's first offence and that he has no intention to cause any harm with the weapon.

Prosecuting officer Inspector Rasydan Jasni, who tendered the facts of the case, urged the court to impose an appropriate sentence.

The court ordered the seized weapon to be disposed off by police.

Meanwhile, a 31-year-old man who pleaded guilty to assaulting a man in Penampang will know his fate on Oct 9.

Magistrate Cindy Mc Juce Balitus deferred the sentencing of Moison Subangkir following an application by his counsel Ram Singh.

Ram applied to defer the sentencing for a month for Moison to raise possible money to pay for a fine and compensation.

Moisin admitted to causing hurt to one Jatin Jais with a drink glass on May 14 at My Café, Beverly Hill.

Inspector Albert Basiri, prosecuting, told the court that on the said day, Jatin was having a drinking session with his younger brother when they were assaulted with beer bottles and glasses by five men.

Jatin knew three of the men as they worked at the same place as him.

One of the men, Moisin, was arrested by police on May 16 and confessed to have attacked Jatin who suffered injuries on his head and left shoulder.

Moisin faces a jail term of up to one year or a fine, or both, if convicted under Section 323 of the Penal Code.

He was released on an extended court bail. – Jo Ann Mool
