Man ordered to undergo mental observation

Kota Kinabalu: A 22-year-old local charged with raping his ex-girlfriend was ordered to be referred to Hospital Mesra Bukit Padang for mental observation. Sessions Court Judge Azreena Aziz made the order on Mohd Azhar Jeminos after the prosecution requested for him to undergo mental examination due to brain injury.The prosecution informed that the request was made as when Azhar had been involved in an accident in which he suffered brain injury. ADVERTISEMENT The outcome of the observation will determine whether the brain injury had affected Azhar's state of mind and whether he is fit to stand trial as well as his capability to make his defence.The court set Nov 1 for mention.Mohd Azhar, who is currently released on bail of RM10,000 in two local sureties, is accused of raping the 15-year-old girl at 11am in March 2015 in a hut at a village in Tuaran.The offence under Section 376(1) of the Penal Code carries a jail term of up to 20 years and whipping, on conviction.ADVERTISEMENT Deputy Public Prosecutor Husna Abdul Halim appeared for the prosecution while counsel Azhier Farhan Arisin represented Azhar.Azhar was accompanied by his family members during the proceedings.
