Drugs: Man goes free

Kota Kinabalu: A local businessman walked out a free man on Tuesday after the High Court here acquitted him from a charge of trafficking 6,371.2gm of syabu without his defence being called.Judge Nurchaya Haji Arshad held that the prosecution failed to establish a prima facie case against Mok Kha San, 34.

She made the ruling after studying all the evidences adduced by the prosecution and matters raised by the counsel and having read the submissions submitted by both parties.

Mok thanked his counsel Ram Singh.

"I am so happy. I have faith in God and my counsel," said Mok.

Mok was accused of committing the offence at 1pm on Dec 1, 2015 in a room at the MS Perfect Beauty Centre, Damai Plaza here.

The charge under Section 39B (1)(a) of the Dangerous Drugs Act carries the death sentence on conviction.

The prosecution handled by Deputy Public Prosecutor Gan Peng Kun had called six witnesses in the trial at the prosecution stage. - Jo Ann Mool
